Can you get workers’ compensation for a crash on the job?

On Behalf of | Oct 31, 2019 | On-the-job Auto Accident Injuries

If you drive for work, there’s a chance that you could eventually end up in an auto accident while on the job. For example, if you need to drive between client sites for work, someone could run a red light and hit your vehicle. That incident is not technically related to your work, but because you are in the process of doing work by driving while on the clock, you should be able to seek workers’ compensation.

If you are involved in a car accident while in a company vehicle, you should try to let your employer know as soon as possible. In your situation, you may be able to file a personal injury claim against the person who hit you. You may also be able to seek workers’ compensation since your injury happened while you were on the clock.

Are there times when you won’t qualify for workers’ compensation if you are hit while in a company vehicle?

Yes. If you are driving to or from work and are not on the clock, the likelihood is that you will not be covered by workers’ compensation. If you are traveling for any reason that is not related to your job, it is unlikely that you will be able to file a workers’ compensation claim in that case, as well.

If you aren’t sure if you can file for workers’ compensation, simply ask your employer if you can make a claim. If they say no and you think you should be able to, you may want to consult with your attorney about your options.
